The airline industry will release a COVID-19 passport for your iPhone next month

After successfully trialing it on an international flight between Singapore and London earlier this month, the IATA says it will release its Travel Pass app in mid-April. The software allows airline travelers to store verified COVID-19 test results and vaccination certificates on their phones. In my opinion, this is a tempest in a teapot. I have spent the last 35+ years flying millions of miles all over the world to serve the oil & gas industry. I always had my WHO “Yellow Book” with me listing all immunizations necessary for entry into a variety of countries. Without this yellow book, entry was not happening unless you wanted to roll up your sleeve in a very risky situation. I don’t see Covid vaccination being fundamentally different from Yellow Fever vaccination. Some may say this was paper & not a database but your information was certainly stored & later, digitized at every entry, I would really like to have this as an app or cloud based in case the yellow book is ever lost (again). There is a very simple solution for those who object to this requirement by airlines & other countrie. Don’t go there.

Hi folks, I'm an attorney practicing aviation law. I know the personalities on Fox News are making lots of arguments about HIPAA and the Constitution in connection with this development, but their arguments really need to be put into the context of what federal law actually is. You have a right under HIPAA (which is not the Constitution) to keep your medical history private. You do not have a right, under the Constitution or any federal or state law, to board an airplane. You board an airliner pursuant to a contract that you create with the private company that runs the airline, on their chosen terms (just like if you happen to be gay, and want to buy a wedding cake celebrating your marriage to another person of the same sex, you might have difficulty getting that done with certain private bakeries that are not as open minded as others). If a private airline, or a group representing multiple private airlines (IATA) wants to create a requirement that you show proof of vaccination prior to boarding, that is its/their right as private citizens running a private company. If you strenuously object to that on HIPAA grounds, you have every right to stay home, or to drive yourself to your destination in your own vehicle. Nothing in the Constitution (which I urge everyone to read--it's really not that long) is implicated by a private airline asking you to show proof of vaccination. Nor is HIPAA violated, because nobody is forcing you to divulge your medical history--it's a voluntary and very limited waiver if you want to do business with the airline. Remember: you can always drive, take a boat, or stay home and watch hours upon hours of political rants on your favorite news station. (And by the way, this isn't coming from some airline industry attorney--I sue the airlines every day on behalf of clients who have legitimate legal claims).

Government bailouts don't save the businesses that they bailout. Without a bailout, the outcomes is very predictable. The business goes bankrupt, the investors likely lose everything, union contracts are nullified, the assets are sold and put to use by a new company who steps in to fill the void.

So, the airlines wouldn't go away. Would 'we' be better off? It depends on who 'we' is. If 'we' are the investors in the airline, then no, we would not be better off without taxpayers money flowing into our pockets to keep us from going bankrupt. If 'we' are the unions, then perhaps not, 'we' would not be better off as we would have to negotiate our benefits starting over with a new company.

But, the airlines would not go away. If this was your concern.

I don't think it is the airlines decision to require proof of vaccination, but the countries they fly to. Most of what is talked about is international travel not domestic in my opinion. My wife is going to Germany in 2 weeks and the country (Germany) is requiring a negative Covid test prior to entry so United is requiring passengers to have proof of the test prior to boarding. I would hope a vaccination card would stop the need for testing before boarding.

When the government has as much oversight, regulation, and involvement in day2day ops of airlines as they do (and should) - then the line between the company and the government become extremely blurred - and both passengers and the airlines have laws, rights and resources afforded to them through that very oversight & integration. Long and short of it - as a federally managed entity, and by all accounts falling under what could be identified as "common carrier" designation (such as in the telecomm realm) - The protections afforded by HIPAA should therefor extend to cover "customers" of the airline, just as they do any telecomm customers.

The airlines are simply operators of a service that is otherwise managed by the Fed. Airlines cannot operate without that management, regulation, oversight and integration.

Airlines are public accommodations, are they not? Which would make your analogy moot.

Dan, I am licensed to practice in several U.S. states, as well as Ontario and England and Wales. I have also taught Aviation Law (and the Constitution) for many years. It doesn't do much good to get deep into the facts of the Colorado bakery case, I was simply making the point that private companies can set their own rules for doing business. Yes, airlines are regulated, but those regulations are primarily for safety. Allowing unvaccinated people on board airliners during a pandemic doesn't seem very consistent with safety, does it? And the fact that they receive tax dollars under certain circumstances doesn't make their airliners public property any more than it makes Bank of America's various lobbies into places where you and your family can have a picnic. So the "public accommodations" argument really isn't a winner.

Influenza killed hundreds of thousands before COVID, and I am sure that many of those caught it while travelling, yet?... Hundreds of thousands of people have died as a direct result of crashes, yet?... Getting up in the morning seems to cause the greatest number of heart attacks, yet?...

I advocate for people to be allowed to make their own decisions in matters such as these. Others seem to believe they have the right to be tyrants over others.

1) The Danish study proved masks are statistically irrelevant in the real world. Is there a cleaner environment than an airline cabin at altitude with better circulation?

3) Airlines, particularly legacy carriers, are among some of the worst run businesses in history, especially in the United States. I had not read the article until now, my Lord, you are freaking out about nothing. There are no mandates suggested in this article. It more a matter of convenience. Especially for countries that may require a quarantine for international visitors. Showing proof you have been vaccinated or tested negative will more than likely keep you from having to sit in your hotel room for 10 days instead of lying on some Caribbean islands beach.

There are plenty of things in the world to get worked up about, folks this ain't one of them.

I’m not necessarily anti-vaccine but I know from first hand experience that cause of death has been falsified or mislabeled. One family friend of my wife’s had a brain tumor, was at a point where she was given just a few days to live and had the cause of death listed as Covid because she tested positive but wasn’t necessarily Covid symptomatic.

My first wife died of cancer. Her cause of death was listed as sepsis. Underlying condition as stated on the death certificate was they actual illness.

I expect your friend's death certificate looked similar to my first wife's. The medical examiner or physician list the immediate cause of death as COVID, helped along by brain cancer.

If you break your arm, go to the hospital, get an infection and die, the broken arm didnt kill you. The infection either brought on by the broken arm or caught in the hospital is what kills you. The broken arm was a pre existing condition.

And if you have a terminal illness, such that a DNR order is in effect before you catch COVID, and then you catch COVID, and treatment is limited because of the DNR order, which is because of the terminal condition, then did you really die of COVID? Especially since without your pre-existing terminal condition you would have, like the majority of others, have survived it?

This is much closer to what happened in large numbers than your broken arm example. But, I'm sure you'll use better examples next time.

Think of it this way if you have a heart attack, then go to surgery and the doc accidentally tears your heart chamber, the heart attack didnt kill you the doc did.

I believe that your analogy is flawed. If you're heart attack was such that your probability of living was just 1% only if the doctor performed a risky treatment, which then failed due to the known damage that would occur inherent with the procedure, what killed you? The heart attack, or the risky treatment?

The reason that this discussion is important is because not all risks are equal. Many, many people, assume that all risk of death is equally bad and must be avoided all costs. If the world ran this way, we would have paralyzed ourselves long ago.

Another way of looking at it. Would you consider your hypothetical death caused by some malady at the age of 99 years old the same tragedy as your death caused by a different malady at the age of 39? I would, and I believe that is reasonable.

Therefore, the tragedy of a thing that kills me one week before I was going to die from something unavoidable anyway is nowhere near equal to the tragedy of something that killed me when I was nowhere near dying. And we should not treat it as the same tragedy, or we are being ridiculous.

Its the insurance companies and hospital admins who are charging the government more money for medicare and medicaid patients ONLY. And most of that cost is for long term care, rehabilitation, and yes some greedy people hospitals and insurance companies.

I never had to show a vaccine passport after having chickenpox, shingles, flu, TB, typhus, cholera, measles, Ebola, plague, etc... NEVER I was asked for a vaccine passport to board a plane as a passenger. Only vaccination required was for yellow fever in case you fly to a country where yellow fever is endemic. They don’t want you to catch yellow fever when you land. I have taken flights transiting in Bangui going to Brazzaville. Passengers leaving the aircraft in Bangui needed the vaccination but not those going to Brazzaville. No mask in the plane, no social distanciation. Don’t mix anything with everything.

Where I live, a voting card is required to exercise your voting right. A citizen concerned with his country's safe and just electoral system will love to have a form of stopping electoral tampering and illegal aliens from voting. That form is a valid voting ID! I just checked visa requirement for Thailand. Being vaccinated or not does not make any difference, Still need the PCR tes, the 2 weeks quarantaine with PCR tests every 5 days before being freed from internment. On top of that you need a Covid insurance of $100,000 even if you are vaccinated or not. Now with 99.6% recovery rate in case of infection, my chance of recovery is much better than the hypothetical short, mid and long term consequences of the vaccine.

You would simply be required to show a negative test before boarding and, in most countries quarantine for a given amount of days. As everyone else who chooses not to submit their vaccination information. So there are other options for people unable or unwilling to take the vaccine. It can be inconvenient and cost more to travel. But as someone with underlying health issues that often reduce my ability to walk any distance, I have to arrive early and wait for assistance, almost always paying for that assistance at both ends of my air travel. So having underlying health issues comes with extra costs and restrictions when traveling, welcome to the real world.

Oh yes, when and which health requirements have been present for travel in the past? Never an airline has been enforcing any rules to allow you to board an aircraft. The yellow fever card was mandatory for entering a country where the fever was endemic. Of course in case entry was denied on arrival because you were not vaccinated, the airline had to repatriate the traveler at its own expenses, so they decided to ask for the vaccination card when boarding and made sure you were not denied entry into the destination country. But even without the card people did travel and enter the country at their own risk.

But as a few astute folks have noted here on today's overblown debate about everything that annoys them, it wouldn't be very profitable for the airlines to make people do something they don't want to do if there is no reason behind it. Epidemiologists seem to agree. We have vaccines now, but nobody knows how long they last or how strong they are against the mutations that are cropping up. Another good reason to be cautious rather than reckless. We also don't know for certain whether vaccinated people are still capable of being vectors for the spread of the virus. We have some developing ideas, but science dictates to proceed cautiously. When I was a kid, astronauts returning from space had to be placed in quarantine because of what we didn't know about what they might be carrying back from space. Careful science eventually determined that we don't need to, and it isn't done anymore. From the beginning of this pandemic, scientists with lots more experience with infectious disease than Sean Hannity and Tucker Carlson combined have urged patience and adherence to things like masks and social distancing until we can eradicate this virus. A little patience and cooperation is not a huge ask, and I can guarantee you that it will not cause the downfall of America. And for those who believe the Constitution says you have the right to do whatever you damn well please, I urge you to actually sit down and read it. It doesn't; that would be anarchy. Instead, it sets up a federal government atop a system of several individual state governments. Government, by its very nature, requires some cooperation with our fellow participants in the government. We aren't sheep, we're citizens. Where is Rodney King when we need him most?

There are other vaccines for deadly diseases required to travel to several countries. Do you ever travel out of the country? I’ve had to provide vaccination proof to more than one country. I’d gladly use this app. But that said, you don’t have to use it but you will have to provide it before you are allowed to board your flight or you will be refused boarding. Just so you understand, this information is for the countries that people are traveling to. So to answer your question about people with HIV, obviously you aren’t informed enough to understand that HIV isn’t AIDS so I’m going to assume you are taking about the former not the latter, several countries do require proof of that. Actually until recently, it was illegal to enter into the US if you were HIV positive. So, yes countries can require proof of anything they want from people entering their country. I think everyone here needs to understand that this is simply a way to make providing this information. You don’t have to use it but you will have to provide it to get on a flight to certain countries because that country requires it.

I have flown internationally several times during the last 12 months and passengers have been without mask during the lunches, dinners or drinks serving times for almost an hour and nobody complained. So this mask mandate is totally absurd (even crew members are fed up having to wear this mask for 12 or 14 hours. Several times I went in the galleys to get some drinks and snacks and the flight attendants did not have their masks on.

Covid 19 infection is different than other illnesses mentioned since it is airborne transmitted. We have never had a real pandemic since 1918 influenza when only ship travel was in existence. The problem for me is that anyone can forge a vaccination card. There will be difficulty confirming actual vaccinations which are probably collected in each state in some databank. Since this "passport" is all being done after starting vaccination and not thought out beforehand, I think showing your vaccination card is OK and that anyone who is discovered presenting a phony vax card should be fined and banned from flying.

In fact, my husband and I flew from the East coast to Monterey, Ca last October. No repercussions whatsoever. Already booked another trip there for September. So if you get the vaccine, why would you care if the person next you did not get it? Next, polls say about 50% of the population say they will not get the vaccine. A number of people who receive a vaccine (any vaccine) may have less functional immune systems (blood cancers, etc.) For instance, even with increasing age, the immune system is not as functional and a robust response to the vaccine may not be as likely. Sure, maybe fewer will now die and end up in the hospital (as is suggested in the data), but one still does not want to get this illness due to potential long-lasting illness and disability. In addition, herd immunity requires a great number of people to be vaccinated so that the disease is tamped down (much like with smallpox, measles, and polio) protecting the community and lowering the potential for the disease to mutate as it spreads.

Some of us have had COVID and recovered. There is no medical evidence of statistically significant reinfection. In fact, vaccinations don't claim greater immunity than recovered COVID immunity. But airlines and some states want proof of vaccination without consideration for recovered COVID patients, who have natural immunity. This is discrimination against persons based on recovered COVID status. "Passports" should identify recovered COVID, negative COVID test results, and the vaccinated.

Airlines are public transportation. They have been rescued so many times because of tax payers funds. They use public facilities like airports, FAA, ATC paid and maintained by tax dollars. So they cannot hide behind being a private corporation to refuse service to the general public. Then tomorrow the NY transit shall do the same and stop access to millions users who have paid the salaries of NY Transit employees, maintained the network and financed the new investment in rolling cars.
If tomorrow a majority of people decide to have an embargo on the airline industry then the whole economy goes bankrupt (aircraft manufacturers and suppliers, airports, construction and maintenance companies, chambers of commerce which finance the airports, shuttle buses, utilities corporations, oils and gas companies, etc...). One thing is certain, the airline industry shall loose. Blackmailing is never profitable because other companies (outside of IATA) shall take over the business.

When a "Destination" entity decides that the incoming airlines must PRE "screen" travellers, either by demanding an "approved" negative test or perhaps just PROOF of two shots and a MASK, that is their right. It has nothing to do with the US Constitution or your "individual" rights as you may see them.
Our local "state" government has already come out with an APP, part of which will accomplish the same thing as the future IATA APP which will be proof of vaccination or as some are CALLING it: A VAXX PASSPORT.
Since I'm already providing the GLOBAL ENTRY/NEXUS systems at the airport all the information they require to qualify as a PRE-CLEARANCE traveller, I don't have any problem ADDING the VAXX info to my Govt Health APP or to the IATA APP. Whatever is best for me to quickly pass through the PRE-CLEARANCE line works for me.
Those that can't or won't get these "clearances" have a different line where they can "explain" their problems to the always receptive government agents while I've already gone on my way.
